95 EGR system failing smog

I am having issues with the EGR system on my Talon TSI AWD. I will do my best to explain and give all the facts. Any help is really appreciated.

It is a 95 TSI AWD with a 6-bolt swap. I live in CA, so I have very strict laws. The motor swap was approved by the state ref, but he mentioned the EGR system is not functioning. I was wondering what exactly that means and what is the best way to test/verify it is working.

I brought the car to a smog shop after the state referee ok'd the swap and they told me that it operates fine until they give it throttle and they dont see any vacuum?

All the hoses seem to be routed correctly with the 4th port on the throttle body caped, since it has nowhere to go on a 2g I believe.

I also have DSM link and have unchecked the DTC for MDP/EGR, so I dont get a check engine for not having a MDP, I was thinking this could be causing the EGR to not function correctly, but I am not sure and wanted to get some confirmation/clarification on the issue.

Have you pulled vacuum from the egr to see if it even works in general?

As to synthetek, here in utah as I remember since I do smog. It does not matter what engine you put in what as long as its newer then the motor being replaced, and as long as it can prove that its cleaner running then original motor. All this can be done once the area's health department signs it off as a suitable replacement. They say they are not anti performance, just it needs to be up to par on there standards.

a 6 bolt is not newer than the motor its replacing in a 2g, that's why it seems unusual. They are very strict here, they will fail you for stuff that's supposed to be carb approved even if you have the carb sticker, they will also hassle you for intercoolers even though the smog rule book says its ok change them.
