cold engine - partial open wastegate?!

When my motor is cold the wastegate is partially open even at idle but once it warms up it seems fine. It is a 95 tsi awd with a 14b install and a dump tube, which is why I know its open. Any ideas as to why this is happening? I am really stumped.
 
Are you sure it's the wastegate flapper? Check wether or not the actuator arm is moving from the time it's leaking until it stops, thus leaving the flapper open. If it's staying still (which i'm fairly certain it is) My first guess would be that the exhaust housing is cracked or warped to where it's leaking from the turbine outlet over to the dump tube outlet until it warms up and expands enough to seal up.. I would say that's what's going on based on the million and a half cracked MHI turbine housings I've seen, fixed and thrown away.

The only time i've seen waste gates open under idling/cruising conditions is when it's exgternal and the vacum lines are hooked up wrong.
 
I am positive its the wastegate flapper, you can definitely tell its coming out of the dump tube. I will check the flapper and see if it moves while the car starts to warm up.
