What triggers code 43 CEL?

I keep getting code 43(EGR) because I dont have an EGR anymore. What does the ECU look at to trigger this code. My 2g never pulled a code for no EGR but this 1g does, whether the solenoid is hooked up or not.
 
I am not sure if the car is from CA, but I know it has a rebuilt ecu, which may be a CA ecu.
I tried plugging the egr solenoid back in, but the code still comes up. Must be because of the EGR temp sensor, can anyone show me a picture of where this plug may be so I can put a resister across it? Or maybe tell me the wire colors?
 
Putting a resistor across the wires at the connector? That seems doubtful. If you have a EGR valve with a sensor, it's screwed in to the EGR on the side of the valve, adjacent to where it's connected to the manifold. The EGRT sensor wires go to a connector at a location behind the engine near the firewall. You can find pictures of both types on EGR valves on Ebay. Hope that helps. My CEL 43 problem is still there, it comes on every now and then for reasons I haven't been able to track down. I see it more in warm weather.

Can you sed me a picture of this said connector, or at least let me know the wire colors? If the problem can be fixed by wiring a resister at the ecu, putting a resister at the connector would accomplish the same thing.
 
This is the closest I have to a picture, but it just tells you where the connections are. The connector harness behind the engine is not really easily visible. The Haynes manual has some pictures but don't really show the connector. You could be right though, the sensor is basically a thermistor that puts out a variable resistance.

I've read that also a code 43 code also mean a problem with the ECU. Believe it's the Chilton manual that says if it ain't the EGR most likely ECU. But yea a Cali ECU will give you a 43 if an EGR isn't present or not working correctly.
 
Ok well I opened the ECU up. Turn out it does not have a resister in r129, making it CA software.
I soldered in a 1/8 watt 1k ohm resister in r129 so we will see if my CEL comes back!

Update, drove the car a lot over the past day or so no CEL. Fixed.
