Need a Jailhouse Lawyer

The cost for that lawyer is ridiculous..back when I was a retard, aka 16, I pretty much ran from a cop. Thought I got away but he was waiting for me near my house. I got three tickets...C&I, 21 over, and a failure to yield to emergency lights. 500 dollars later with ALL fines, fees, court costs, etc paid I have nothing on my record. The cost must be extremely high in Hawaii or that racing infraction must be extremely serious for the lawyer to charge you that much.

Anyhow, as said before, cops don't have to show you the radar..trust me, I work with them. And no, cops don't try to be dicks and give tickets to everyone they can. They have to meet a quota and/or some of them are specifically assigned to a certain duty and if they don't perform that job then they are in deep shit with their higher ranking officer. They have a job just like anyone else, don't get pissed off at them if they are just doing it.

Well, both times you did something illegal resulting in you getting pulled over. I understand you were somewhat inconvenienced by it all, but in the end you weren't doing anything more than what they pulled you over for. They have a job to do and criteria to meet just like everyone else. Can you imagine what would happen if cops just took everyone's word on everything?

Point was, I should have gotten my appropriate ticket and moved on. This was no smell. there never was even before that. Its not like there was residual smell. My car was bought from a dead old man, and my friends car was never smoked in. I didn't smoke in it, and I doubt a man of age ready to die is not smoking in his car. And his PROBABLE cause was the smell of "marihuana"

My theory is cops are dumb because dumb people dont think. thinking requires time (especially if all you have is a HS diploma, which guess what most coppers only have, then go to cop school). time that slows reaction. a combination of making wrong decisions, and the power to make wrong decisions makes for a lot of bad cops but it is the only cop that has a better chance of survival in general.

Now a really good cop can think while reacting just as fast. That's why they don't have rewards for such specimens because so few would get them.

Im not arguing that I shouldn't have been pulled over. I should have. I shouldn't have been excessively harassed for NO reason.

The cost of the lawyer is 1/3 of what I would pay. I'm good friends with my friends mom, and she used to serve warrants and such for the local police. All is well though because I made the dumb mistake of rolling with the group in the first place.

In the eyes of a judge, they will problably assume I was racing. When in fac tI was just speeding and some kid problably just wanted to see if he could go faster than me. When through those facts it would be called a contest of speed, but myself unknowingly a contestant, would be fated to the judgement of a court to decide either to penalize me or not. I hope my lawyer can navigate me through this legal situation. I also hope that the court will decide in my favor as to what to do with me and that they find me innocent. Traffic laws and the justice system are imperfect, but I hope that somehow get through this without trouble.
 
My lawyer is going to cost 1700 dollars. I'm getting a good deal seeing is how he charges per violation and ALOT more. Pays to play and being in the wrong place at the wrong time can cost you big.

Holy HELL! I paid 280 to get mine dismissed.. and I had a suspended license at the time due to not paying my state surcharge. Needless to say, I took care of those.

Anyway as far as fees go thats only the lawyer fees and that's half of what I would pay if I didn't know the guy. He sounds and seems pretty confident on getting the charges lowered to petty misdemeanor, which in hawaii MAX punishment for my ticket would be jail.

^^ damn sounds like you got raped on those lawyer fees. I mean he better be one of the top lawyers from where you are from or something because when I needed a lawyer for a traffic incident it was like $300 and he was a former District Attorney who had connections. Oh and just so you know lawyers almost always seem pretty confident about your case that is up until you pay that retainer.

For real man, don't be dumb.

And how many of theses people saying incomplete/incorrect forms mean anything have actually one that argument?

^^ That's not entirely true because I won some traffic cases on errors or omissions and incorrect information from what the cops wrote on the tickets. Not saying that it will always get you off but those technicalities does help and play its part when attacking the credibility of the officer.

You'd be surprised how many cops know math, unless its in bakers dozens... And you might (shouldn't be) surprised how often (at lease MD cops) cops pull the funky green card. 2 of my most recent encounters...

Just pay the ticket and be happy you didn't go to jail...I was on my 07 gsxr 750 and some POS car was doing the similar thing trying to race me and I went to jail for street racing.

So. Today was the big day. The judge presented before me this possibility.

1 year in jail and a 1000 dollar fine, after which I would be mandated to have sr22 insurance for 3 years, along with a 1 year probation as well as more than 100 hours of community service.

My lawyer (God bless him) talked to the persecutor into downgrading the speeding over 81 mph to simple speeding a 300 dollar fine, for pleading guilty.

For the racing on highway, I would pled no contest and waive my rights to fight that portion of the case all together and have no say on the outcome, which was scarey knowing what could be instore for myself. After signing a terms and condtions for the agreement over the speeding charge no reduced I would have my racing on highway deffered off my record and serve 6 months arrest and conviction free, along with defensive drivers training for 1 weekend. Restricted to the island of oahu for the duration except for employment purposes ( deployments and such).

If we would have fought the case it would have drawn out for a long time and a lot of he said she said would have been thrown around because the officer who wrote the ticket.. wasn't the one who pulled me over, the vehicle in question I was racing, was technically never pulled over. That ford focus which was now indentified was only mentioned on my ticket and not the report. I think that ford focus was a cop. Here's the reason me and my lawyer decided that making the deal was my best option. The fact that IF the slim chance I woulda lost against the state, id be sent to jail, no deal. So you can see the small window of opportunity to keep my record clean and avoid the larger risk was taken.

Honestly paying a fine is a lot better than anything involving a police record or jail. I got the better end of the stick I feel. Thanks for all your support and now you can flame away.
 
When did a Ford Focus come into this? I thought you said it was a Toyota Yaris.

It was a toyota yaris. But I had to accept the fact that what was on the ticket was on the ticket. The officer that wrote the ticket wasn't the one who pulled me over, and the ticket wasn't complete when given to me, but then completed before the court date.
 
I dont see how you missed that. Around here, Yaris's turn into undercover police packaged ford focuses all the time. Especially when you race them. ROFL

Those last two didn't smell at all. Both times were in 2 weed virgin cars. Never even had cigarette smoke.

And yes MY subset, is small compared to the population... But it is MY subset and thus reflective of MY experience. I hate stereotyping and bashing of groups of people, but cops have proven USELESS in my life to me. I'm sure they have helped others. but about half of the experiences I have had, ruined it for the others.

Here's what permanently will bias me until something of equal and opposite magnitude occurs (which will clearly never happen):

I was walking home from the bus after getting off work (Fine dining kitchen in DC). (1:30am) I light a cigarette, walk 3 blocks towards my house. On the 3rd block (of 5) I get mugged (attempted) I run, and get shot in the leg. Adrenaline keeps me running through 2 blocks of backyards to my house. I call the popo and an ambulance, because I clearly need both. They both come, at this point I cannot walk. In the same pocket as my phone, The Detective pulled out a balled up seran wrap, about 2ftx1.5ft. It was used to wrap my smartphone so it doesn't get food/dust/mess on it in the kitchen I work 12+ hours a day in. I take it off my phone after my shift and usually forget to throw it out. He unwraps it and smells it, and proudly proclaims that my assault was a drug deal gone bad. I tell him to put that into evidence and test it because that conclusion is impossible. I then spent the next 3 hours in the hospital with doctors watching me while this detective interrogates me and calls me a liar. I ask I should be receiving treatment, he said not until I tell him the truth. After three hours pass of me telling him over and over what happened, I start to get pain relievers, stitches, wound cleaning etc...

Now tell me cops are always looking out for the better of everyone without bias.

I believe cops have the right intentions, they are just too close minded. They are "dumb" for a reason and act on instinct only. This is because if they are doing something useful, like saving a life, they dont have time to think. In the time it takes their little brains to think, they will have missed an opportunity, or put themselves in serious danger. I pity them.
