Your pretty boned, it's your word against his. Best you can hope for is them to drop one charge and deal with the other, and that's if you get a nice cop/judge.

Yeah, you could get lucky or get totally screwed, it just depends. I was in traffic court last week (no state inspection, false tags, unregistered vehicle...) and saw some pretty whacky stuff. Even if you're lucky just paying fines, it's still crappy. The judge reduced one of my fines , I prepaid one of them, and got the full fine for the other. So I walked out of there happy, thinking I would be paying a little over $100. Nope, the f-ing BS "court costs/processing charges" pushed it to well over double that amount. One of those court costs/processing fees was more than the actual fine I received. Amazing how everything is basically done online now taking about 5 minutes (reporting it to DMV, insurance, court records, etc), yet they charge you like takes hours of manpower and postage to do it. :mad:
 
Buck up and pay,or get a lawyer to drop or reduce charges. Its a life lesson hoppfully u learned somthing from. Oh and dress nice. Somthing to think about, next time someone is driving like a idiot let them by. They could be on drugs, drunk or what ever. Its better to have a idiot in front of u than behind you.
 
It doesnt even say he radared you at that speed on the ticket does it? There must be some room to work with that!

Not going to lie - this post stands out.

When playing with your license and money, an officer should be required to fill all of this information out. It's rather pertinent.
 
They can get your speed by pacing you. Besides, the additional charge of racing on the highway doesn't help.

Pacing was a selection on the ticket under the section where the police officer should need to fill out how he obtained your speed. That selection wasn't checked. I'm just saying that in such a situation - all fields should be filled out. I can't turn in half-completed forms here at my job and expect to keep it long. Ya' dig?

There is some serious "blind leading the blind" in here, BTW. "You have to see the radar". HILARIOUS. Eyeballing based on fixed points is admissible in court, kids.
 
There is alot of great advise here guys thank you. Like I said I'm contacting an attorney after lunch break is over hopefully I can get a solid handle on this and see what my options are.

I wont be selling my DSM to pay for a lawyer.

Worst case, I lose my liscense either for a short period of time or forever. I'll problably still keep my DSM and continue my project after paying all the fees associated with this ticket. Somehow it will work itself out.

Did you ask to be shown the radar, and video of you doing 81mph? If you did not know that they had to show you the radar if you were asked I'm afraid your going to have to take the ticket with no lube.

Bud, this is not true. Police officers do not have to prove it to you. They are not required to show your the radar or anything else. They often will, or provide an explanation out of experience but they do not have to.

Where I am from I believe that if the police officer does not radar you, he cannot designate a speed that you were traveling. Therefore you get some kind of a "generic" speeding ticket.
If the police officer does radar you where i am from then he has to provide service records and proof that the radar gun was calibrated and "tuned in" or whatever you would call it both before and after pulling you over.

I asked on the off chance that a lot of these car guys are also daily professionals on some way or another OR have found themselves in a similar situation. Maybe one of these car guys is a legal advisor, or has working knowledge of local, state or federal laws.

My lawyer is going to cost 1700 dollars. I'm getting a good deal seeing is how he charges per violation and ALOT more. Pays to play and being in the wrong place at the wrong time can cost you big.

Profile say's your in canada, i've never been ticketed in canada, but in every US state i've driven in, and been ticketed in (which is a few) they are allowed to get there speed by "check points" if you will. One set point, such as a bridge, and another a set distance from the first, and they time how long it takes from one to the other. From that they can get your approximate speed and it does hold up in court.

They are also allowed to pace you and gauge your speed from that as well.

Even then, dont do it when you just split from a pack of racecars. while you have all kinds of baby testNOTserone (testosterone from ####!es) flowing through you. Why even play with a yaris? that like going to a elementary all girls school, matterfact, a female infant nurtering center, to get your willys off. WTF mate?

Nice rant. Contest shmontest, if I was racing I would say I was. I used to go to the local drag spot with my prelude and "race". That was a long time ago. I dont anymore becausebreakcar.

Anyway as far as fees go thats only the lawyer fees and thats half of what I would pay if I didnt know the guy. He sounds and seems pretty confident on getting the charges lowered to petty misdomeanor, which in hawaii MAX punishment for my ticket would be jail.

Anyway looking into how much court fees and the ticket would cost after being reduced, I'm still looking at around another 1500-2500 dollars. Which lead me to KBB. My car is currently worth $6400+

Money for the lawyer too easy, money for city and county... meh

I'm destroying the hope the DSMTuners BAR Association is hinting at...

Eyeballing speed and smelling some funky green are both easy enough that either of us could do them with little to no training. One is basic math, the other is realizing that there isn't a dead skunk in the trunk after all. ;)

The real problem here is the street racing infraction. A speeding ticket is small potatoes compared to that whopper. A lawyer is definitely the way to go.

100% myth Bud. They don't have to show you anything. Believe me my friends dads a lawyer and we ask him ridiculous questions like this all the time.

Does a Speeder Have the Right to See the Radar Gun?

Your best bet would be getting a lawyer and the calibration logs for his gun. Good luck

Paying the first 850 dollars today for my attorney. He seemed pretty confident in getting my racing on highway either thrown out or reduced. The speeding portion will most likely also be reduced, depending on what is on the law enforcement copy of the ticket. I'll keep you guys posted. Maybe this can serve future tuners in some sort of way.

LOL (at the bold point) you seem sort of smart so this wasnt a rag on you but on people that do the same stuff that you did. It was a speed contest to a degree. I do doubt it was an all our pinks race, but he did engage you and you paced him. you may not have out paced him, but you did participate in a contest. that contest having to do with speed therefore a speed contest which is commonly used in the court room interchangeably with street racing. (I know its an unfair exaggeration, but likely) bottom line it was a speed contest, just not the type you are used to which is why you justified it.

Think of it this way, Had the yaris not been there would you have driven exactly the same way? I think not. ( I actually know "not" because you said "[you] should have just pulled to the next lane and let him pass...") then again, you will probably say yes to try to prove your point, and I will laugh, just like the judge. because you are being blatantly wrong by lying to me. I hope you are not also lying to yourself.

Your gonna have to use some logical fallacies and some clever wording, and some dodging certain questions in the court room, and with a good lawyer, and a little luck you lawyer fees will be around what you are quoted, and your state fees will be around $300 and no points(20 over, and court costs, in my state thats like $200)

You'd be surprised how many cops know math, unless its in bakers dozens... And you might (shouldn't be) surprised how often (at lease MD cops) cops pull the funky green card. 2 of my most recent encounters...

1- Me and a friend (roommate) had to pay rent due in a week. We pay by cashiers check, we always get the check out a week early. We drove to the bank in his car, (he never smokes, he hates it, and thus its NEVER in his car) around midnight get cash from the atm, make an illegal u-turn, get pulled over. The he pulls the i smell marry jane's cooter card. We are held up, car torn apart, and dog rapped for about an hour total (waiting for the dog etc.) then let go with the u-turn ticket. He probably used his little pea sized cop brain to deduce that 2 young adults at an atm at night are getting ready to buy drugs, not the next months worth of roof. And he probably thought he was 100% right.

2- Last semester, I had to return a book. that day was the deadline in 30 minutes (it was a rental, I would have had to pay full price for it plus late fees if i missed it) and had no front tag. Cop pulls me over, no front tag. I explain "Im Sorry, I know I dont have a front tag, I know my windshield is not a front bumper, but I just finished a FMIC install and I didnt have a crash beam to attach it to and I lost track of time...blah blah" I was so pressed for time and I explained my book situation. Since I jumbled some of my words trying to beat the buzzer, he must have mistook that for being high or something. (my car is clean as hell, check my mileage, I will never smoke in it, not anything, and I dont smoke while im enrolled in school). He pulled the weed card, and pulled me out of the vihicle to search it. He found grass, leaves on the floor (it was in the fall, shit like that gets on your floor. he picked some up, clearly grass and leaves and states hes calling a drug unit for a test kit. I had to do a lot of begging to be let go. Thankfully he let me go. I made it just in time to return the book.

COPS ARE HELLA DUMB (or at least power abusive, and quite ASSumptive)
