Advice on buying a used transmission?

I have been looking for a 1g AWD transmission (transfer case too) for a 91 eclipse for a while. I finally came across a local one which is clamied to have under 40k miles on it and shifts just fine, came out of a car that blew the engine. He wants $325 for it as is, or $425 to guarentee (meaning he would refund payment if it DID NOT shift fine). While it sounds a little sketchy...I need a tranny and this is the first I have come across in a few months now. I live in Alb, NM, where DSM parts are dam hard to find. Anyone? any advide on transmissions (and transfer cases)..advice on buying one? would be VERY much appreciated. Thanks

Sorry about the WTB thing OldMan. I didn't really think I was leaning towards asking if anyone had one available, just asking advice. But i changed it regradless, I still need some help advising me which way to go.

So where can you get a factory built one for $800 Jayrolla?
 
Well I got a simalar deal $395 90 day 3,000 mile waranty it made it past the waranty but now 7,000 miles 2nd is gone but I raced mine a couple times and snapped two axles with it so I would say if you don't beat on it it will hold up for a while.
 
The only time I would consider an used tranny is from someone I know/trust or if it's coming off a car I can test drive. I would give my money to someone else even if his tranny is perfect, I don't like how he jacks up the price, greed and trust mostly don't go together.....mostly.
