Do I have a chance of winning this speeding ticket?

Alright well last week I got pulled over heading to dunkin donuts at 3 a.m on route 114 (two lane small highway with a small median dividing each side.) I was doin 40 (was in 3rd gear just cruising) making sure I didn't get over because the cops have my number (got in a little trouble buyin beer with a fake id .) The cop has pulled me over many times for no reason at all and has ripped apart my car searching for something that I have no idea about (don't do any drugs or anything.) But anyways, there were two cars infront of me and one behind me, one guy was flying infront of me. The cop shined his huge spotlight on my car, put on his lights and pulled me over. The cop tried sayin i was doing 61 in a 40. Let me remind you that he was also moving in the opposite direction. The ticket was for $258 and it had radar and estimated checked off. I have no idea how you estimate someone is going 61 mph when you are moving in the opposite direction and there are 3 other cars around you which 1 of them was going faster than you. Do I have a legitmate case or am I just gonna have to accept the fact that cops are corrupt and like to F over people because they have deep issues with self esteem and need to get off to screwing over people?

its a speeding ticket, you're not even infront of a judge, you're infront of a group of administrators. also, i have never got a speeding ticket.

Do what he said. Pay a good lawer $500, but get some one who has lot of local connections. It sounds like a six point ticket, between the fine, court cost, surcharge, insurance, it would be cheaper to pay a lawer and knock off that 6 points on your record.

If you plead not guilty, you'll be in front of a judge. Unless it's different in MA.

It's infront of a couple administrators in MA and it's a first offense, small speeding ticket (not the 6 point.) The ticket is $250 and I don't believe there's an increase on the insurance for a first time violation. You can't have a lawyer for a speeding ticket like the one I got...

same thing happened to me and my friend...we were going 55 in a 40 and the cop was coming in the opposite direction and pulled us over...said we were going 65....the thing is it's u agianst his word...if u go in iwht no lawyer then this experience will win...a lawyer might help cuase my firend lost the case

Well i have a few things goin for me. 1. the same cop and several other cops have illegally searched my car several times. 2. he said i was doing 61 however its estimated... clearly he's making something up if he said i was goin 61 just to make the speeding ticket another $50...

i wouldnt care about the 250, its acouple points on ur lisence but them they disapear after 2-4 years (in NH not sure how it is in MA) 500 for a lawyer isnt worth it.

as for the drinking part, heres a suggestion, come sober

first you should go to court.. I only say that because in NJ if you have the speeding ticket and the police officer that give you the ticket have to be there to prove it. Not sure what MA law is but if your ticket have points you should get a lawyer but if you dont just go to the court and see if the cop is there. If cop is there tell the judge you story, how he was on the other side of the road and tell them to show you the result of the radar because when police pull you over i think they have to print that out to have it on the record just incase you fight for it in the court. . So if they dont have that, than i think you should be okay.

A little hint, atleast here in Kansas but should be most places, is that cops don't have to show you the radar, but they have to show you the radar registration/license. And it has to be recalibrated every 6 months, otherwise the ticket can be thrown out because the radar could have been out of calibration. Just my $.02. Good luck, oh and I may only be 17 but when you boss is one of the top sheriffs officers in the county and your friends with all the cops it helps. Oh and my best advice is just don't be too stupid but everyone has to sometimes so just don't get caught.

Yea you're absolutely correct the only thing they have to show is if the machine has been calibrated within the last 6 months (my dad is best friends with all the cops and thats what they told him.) Also you are correct if the cop doesn't show up the ticket is immediately thrown out.

I've been pulled over alot and had to appear in court over 6 times(even 1 via fax to NJ), never once was a cop present or were any of the tickets thrown out.


However, I know NY has a Traffic Violations Bureau inside the District Attorney's office of every county. Their main purpose is to reduce traffic tickets for lower points, and even lower fines sometimes too. I've called them every time I have been pulled over, you just tell them what happened, and what ticket you got, then they just tell you what they can reduce it to, send you a waver in the mail to sign, and tell you to send your ticket in not guilty and wait for the waver to send to the court. It's that simple, if not for this option I would have maxxed out my 11 allowed points on my NY license a long time ago.

ok here is where I get flamed....

in responce to the "estimate" issue you have.... the hardest thing about getting certified to use the radar is the speed estimation drills. you have to be able to estimate with in 4 mph of the vehicles speed. it takes a LONG time of sitting on the shoulder of a road looking at a car, and then hitting it with the radar to see if you are right. on the test you are given 5 chances. you must get 4 out of the five within 4 mph or you fail. the 61 was what the radar stated. not really what he estimated. he checks off the estimate block as a reason to hit you with the radar. since he was mobile and not stationary, he normally wouldnt run with his radar on.

I would suggest springing for the lawyer if you can, otherwise just go, and pay the fine..

Oh? No probation on your prior bust? That'd give them search rights.

Not likely. The cops seldom have to lie to make a speed ticket.

As for it being mobile radar, I'd be surprised if it wasn't these days.

First of all, fight EVERY ticket, regardless of if you're wrong or right. The system works so slow here in MA that it will, at the very least, buy you time to collect your thoughts and wirte stuff down. Second, all speeding tickets say estimated, whether they're radar or laser. That's just to cover their own butts because they know that these devices aren't totally accurate all of the time.
When your court date does come, there's a couple of different things that can happen. If it was a state cop, you'll be in front of a magistrate and another cop will have the ticket in front of him. He'll read it, then you'll get to tell your story and the magistrate will make a decision. If it was a local (city/town) cop, you'll either be in the state cop situation I just described or in front of a judge and the cop who wrote the ticket has to show up as well. If he doesn't show, you win. If he does show, he'll read his ticket and try to remember what happened. Then you tell your story.
The parts you have going for you are as follows:
In the state cop situation: It's you against some guy, who wasn't there, reading a ticket. He doesn't have any other info about that night other than what the cop wrote down.
In the local cop situation: The guy may not show. If he does, he's still reading a ticket. Then he's got to remember that night, which, thanks to our lovely system, could be months ago. I got pulled over last February and my court date wasn't until June!
You were also in a group of cars, so the cop would have to have reason for singleing your car out, which will be pretty difficult if he's not there. You've also got the fact that it's your first ticket. Most courts will throw those out, but even if you are found guilty, your insurance will waive the points.
Just remember to speak clearly and respectfully, and you should do OK. The best case scenario is that the ticket is thrown out. Worst case is that you have pay the full amount, but will all those things in your favor, that's highly unlikely.
Oh, one last thing. Yes, you are "just gonna have to accept the fact that cops are corrupt and like to F over people because they have deep issues with self esteem and need to get off to screwing over people?"
