I recently got a ticket. I was pulled over and recieved an "unsafe start" ticket. Now I was in bumper traffic and The cop said he saw me "fishtail" and he said "I know what I saw". Now I don't have enough power nor supporting mods to actually accomplish this without stalling or braking something. I am lookiing for as much certified info as possible stating that the car is AWD and/or anything about AWD burnouts being bad, dangerous, or anything about it. Thanks for your help. Zoe.
 
Uh... Or just walk in with your vehicles paperwork and say " I own a 200hp All wheel drive vehicle that is built for traction - It's highly unlikely that even if I tried that I could 'fishtail' my vehicle at all.
 
Always worth trying. People would be surprised at how many traffic violation ticket I got away with simply by showing in court and debating it. Go with what Keiya said, makes perfect sense, and if works like here (in Canada) the Judge has to be 100% sure that you did break the law, if you're argument stands you'll most likely be innocent.

+1 on the reduced fee. I got pulled over for going 64 in a 45 and I asked for a reduced fee and the judge completely waived the fee alltogether and just gave me the points with the MVD. Didn't have to pay a thing.

Just be honest and very polite, even to the police officer. As soon as they see you are upset they will not be on your side.

Try to look at some legal terms too like hear say. That if it is his word against yours and there is no solid proof the court has to give you the benefit of the doubt. Just some legal jargon that can go your way...
 
I agree that you should bring in some info about your vehicle to show your car physically cannot do such a thing on dry pavement. This would be much easier if you were FWD, so I would look up some info how our center differentials work.

In a RWD car, it is very possible for the rear tires to slide around while the car goes virtually nowhere. With our cars the torque split is 50/50 until one of the differentials begins to spin faster than the other (ie spinning tires). Once the rear diff starts to spin faster, the torque is transferred to the front to keep the vehicle moving forward. This is why our cars are capable of such incredible 60ft times at the drag strip compared to most other FWD or RWD cars. Power is always given to the differential with the MOST traction, and then it's split off by the front and rear diffs.

Good luck, i got pulled out of my car, arrested, and my car towed b/c the officer said he clocked me at 112+ in my cobalt when the fuel cut is set at 105 and it wont got any faster plus i had a buddy in his pos car that woud be lucky if it could hit 90 right behind me on an highway at night and could get it thrown out.
 
Try to talk with the prosecuter. They are usually very level headed people. Ive ggotten every ticket I've ever had dropped to no points or only a few (depending on what I did LOL) every time.

Another thing is you could get it thrown out if the cop doesn't show up in court. Your word against no witness. Most of the time they schedule the dates based on their days off. If he's a real azz he probably has a bunch of bs tickets he wrote. What's he gonna do? Be at the court house his whole day off. I wouldn't.

Do you have prior history with this cop? Have you gotten into it with him before? If so he will probably be at court just to slam the door on you.

Oh the big question did you spin tires and slide? :p
 
In my opinion don't fight it just pay it. It's just a ticket you don't wanna waste your time going back and forth fighting a ticket. Pay it bro and get it over with.

Why succumb to improper justice? Why give cops more money to waste on gas so they can cruise around and give other people senseless tickets like this? Paying it is a must, if you have the chance to get it reduced or dropped, why not? Clearly the case is on his side too. Time = money, wasting time would be just paying it without even considering it could be lessened or dropped
 
OP didn't mention grip level. For all we know, it was pouring rain.

OP didn't (and probably can't) say if his center VC is toast. Any front-heavy AWD with a VC center LSD will spin the rears all day if the VC is dead. Try rallycrossing with a dead center VC; same as RWD.

In any event, the proper label for the AWD system in a DSM is "50/50 Ferguson."
 
If you go and argue it with some hard based facts you should get off. It just depends on the judge.

If the judge doesn't just dismiss the charges, you'll probably end up paying a reduced fine. You're right though, it depends on the judge. Sit in traffic court for a few hours and you'll hear/see some crazy stuff.
 
If you do fight it than make sure that you get a lawer. Usually without one they will just ignore anything that you say and go ahead and charge you with it. It might cost more than what the ticket was, but your insurance will likely go up because of it, and it will be cheaper in the long run. I had a similar ticket about 12 years ago in a laser n/t 2.0. I was pulling away from a stop sigh and there was a gravel section in the pavement where they just put a culvert in so my tires spun a little bit in the gravel. The cop pulled me over and told me that he saw me fishtail back and forth and gave me a cni ticket. I decided to take it to court because it was a bogus ticket and figured that i didn't need a lawer because it was a pretty clear cut case. I even had a witness with me that was in the car directly behind me. I explained my case, the prosecutor didn't buy it and they charged me anyway. That stayed on my record for 5 years and caused my insurance to almost double.
