My transmission is..... tempermental. Ideas?

Hey guys.. So my 96 AWD M/T transmission and my ACT2600 pressure plate/street disc combo both have occasional temper tantrums. To start off, everything is fine about the clutch. I had the clutch installed and the trans rebuilt "professionally" by JNZ Tuning And I set the engagement point just where it's normally set at (pretty low) and it holds power great. The problem is, <b>ON OCCASION</b>, the engagement point is almost at the top of the pedal when it's at full operating temperature (e.g. when I've been cruising around a lot). Odd?

Now the trans...
1st gear is fine. No problems.
2nd gear grinds every single time.

Here's the tempermental part..
3rd gear has a mind of it's own, and engages when it wants to. I have tried different speeds, different revs, different loads. Monday it was doing better. Tuesday I did a 2-3 pull and popped it right into 3rd with no problems, no grinds, no hesitation. Wednesday, no problems. Now today it started not engaging 3rd again. If I put it in 3rd, the gear selector goes into the "slot" it's supposed to, but it just revs and you can hear a sort of a crunchy/crackling noise. It's WEIRD

Ok, 4th is fine.
5th got STUCK IN GEAR 3 times on the highway yesterday! (Wednesday) I managed to get it out of gear all three times with a good tug, but today (Thursday) I had no problems with 5th... GAHHHHHHH

Advice! Please!!

I figured.. I just spent a lot of cash money to "rebuild" it. Problem is, JNZ is/was reluctant to honor any type of warranty whatsoever.... So I'm SOL

ya warranty for a race product is tough.but we at dogbox racing try help you guys out as best as possible. Just so you know the problem is only gonna get worse.

What kind of deal can we make on the stage 3 rebuild if I pay cash? Would you happen to have a commercial account with PepBoys? And if so, would I have to take the trans out myself? Let me know, I reviewed your website and it got me very interested. Thanks in advance!
