So like I was wondering what would be the best thing to do in this type of situation. My dad told me today that we have in our insurance policy some type of policy where were insured from people that dont have any insurance for $3500. But wouldn't it be better say if We got the car fixed and then sent her to court for the amount it took to get fixed? or hmmm I just dont know what to do never really been in this type of situation. What should I do guys?
This is just a laymans opinion based on my understanding of the law, it is in no way to be construed as legal advice, just an interpretation. If it was me, I would definately sue her though. This accident will cause financial loss from multiple sources, including repairs, time, insurance rates and so on. Go for it and good luck.
