Wrecked my 93 Laser RS-T taking suggestions on court

radiators broke in half, intercooler is damaged beyond repair, fender hits the tire, massive air leaks, coolant everywhere, turbo snapped in half(metal piees in intake!) air filter crushed, etc. so yeah why don't I drive it 42 miles and cause sever internal damage to the engine? right. even if it were 5 miles I don't want to risk the parts that are salvageable.

didn't realize you said Bumper SUPPORT, I thought you meant the fiberglass bumper, my bad , yes that would have made all the difference, probably saved the turbo.

I went to court today, I talked to a court rep. and she was going to just charge me for ACDA and 40 in a 35 I asked her to look at the file and I read the other drivers report, she said she had NO IDEA what lane she was in and that her car has transmission problems which takes a while to get up to speed, she also said she was driving at about 25 MPH, this made things alot easier for me and the Assured Clear Distance Ahead charge was dropped and The fine for speeding was reduced from 250(4th offense) to 150, then to 85 when I told her that I admitted to the speed when I could have easily lied to the officer. My next problem is insurance, I CAN"T GET MY RECIEPTS BECAUSE PAYPAL NO LONGER HAS MY RECORDS ON FILE!! I can't find them anywhere, it's like they removed everything before september, I don't know what to do about that, any advice would be great, and I appreciate the support!, James.

HAHA yeah thats true ... i slid of the road on dec 26th in the snow going to my g-parents house. i totaled my 02 lancer hit nothing but a tree and got a $250 ticket and 3 points! CRAP!

I talked to allstate just now and gave a statement, they said they don't normally turn around liability claims but that she'll "look into this one" since my ACDA charge was dropped doesn't that mean that It's not my fault? the allstate rep. says that she doesn't have a copy of the report, I'm going to e-mail it to her, the only problem i is that the witness, Ryan, goes to my school, she asked me if I knew him I said no but I seen him in college before, when she calls him what happens if he says he knows me? then I'm screwed I guess, this is BS, I'm taking it to court if they say it's my fault, F*** this Shit!

The only reason All-state is looking into it is because they paid the other driver because it was your fault, since the charge was dropped, that makes it her/no fault and they don't have to pay out. They are only protecting thier own wallet not yours and they are not going to tell you if the settled out of court or not.

You need to go after this ladys insurnace company. Your buddy forgetting to lie isn't going to make a damn difference because All-state is not going to fight this battle for you. Also it doesn't matter that much if the witness knew you or not. He was still a witness.

As for Paypal, they have to have a archive some where. If not they are stupid, becuase they can get sued one day and the have no way to defend themselves. For example. I call today saying that in June, my bank says Paypal Withdrew $100,000. Now I want my money back. If I have a bank statment that says a $100,000 withdrawl was made from Paypal (which I could rig up EASILY), how would paypal defend themselves? So call them and tell them you want a history of all transactions made through paypal and your account.

good point, I talk to Pay-Pal, so what do I do from here? I belive once the rep. reads the report she will understand, Their was also a seperate report from the police officer taking the pictures, It said that the other driver came up to him and told him that She had no idea what lane she was in and that it all happened so fast. Well that's because she wasn't paying Attention! any how if the court saw it wasn't my fault so easy then I hope the Allstate rep. will once she see's the report, the other driver told her that she thought she was in the LEFT lane now, that's ridiculous, she keeps on changing it to better suit herself, atleast in the report she clearly had no idea.

I uinderstand that if you hit someone in the rear, even if it's the left rear it's probably going to be your fault however I think that the insurance companies should realize that there are exceptions like mine.
