so about a week a week ago, a kid (about 17 or 18) came and picked up a wastegate i had laying around... so i met said kid, handed his pops the wastegate, he tries to push the rod down towards the blacktop, so i show him and inform him how wastegates work.

he pays me for it and goes on his way. about 2 or 3 days later, calls me up n says he wants his money back, it doesn't work. goes like this:

me: i didn't try to screw ya, it worked fine when it was taken off the turbo. u had every chance to test/check it out, and ya paid me, so it must have passed ## inspection, and it's caveat emptor anyway. these are used parts. b4 paying me is the appropriate time to verify the functions of these things.

him: i tested it a couple of days after buying it, and it's a piece of shit. "no harm no foul", just give me my $$ back.


The dad: we're all local, just give him his money back.
it was an honest mistake, just give him his money back.
it was only 20 bucks, just give him his money back.
i didn't think it was a big deal, just give him his money back.

what do you guys think? do i give this kid his money back? or is it quite possibly the cheapest way for this kid to learn the dangers of buying used parts/ not checking them b4 buying?

please post, because it'll probably determine if i end up doing so or not.

I would say no. Sucks for kid or anyone in that situation but he could have broken it with wrong install and now wants his money back.

As long as it was in working condition when you sold it to him, there's no reason for you to refund his money. He probably broke it or just doesn't know what he's doing or how to install it.

How's his Dad involved anyway? You're not a shop that has a 30 day warranty or anything, so I don't know what he's thinking.

No way, i'd never give him his money back if it was working before he picked it up. Considering he didnt even knew how it worked, send him a printout on the PC showing him how one works =D

thanks guys for all the posts, i ended up giving the kid his money back.

in the end the kid (and especially his dad) got their 20 dollars back, but when it comes down to it, they're still completely *edited*

so if ## from Naugatuck, CT please shout me out. i still wanna believe there are decent ppl from there.

, tried explaining that to the kid, he threatened me, told me i purposely sold him broken parts, everything under the sun. I thought the dad would understand this concept, (the kid was like 18, i was hardheaded like that too back in the day, ya know?) so i talked to him and he was EVEN WORSE.... he said damn near ANYTHING followed by "so why don't ya just give him his money back"

the both of them were so indignant and arrogant about the situation, they would have just kept talking till they got what they want. Had one of them had enough humility to just say "look, we didn't thoroughly test the part, and we messed up, but we bought it on good faith because you are a reasonable guy and you are local, and if it turns out not to work you're a decent enough guy to handle the situation properly" i probably wouldn't be writing this right now.

but some people u just can't reason with, they don't understand these things.



anyway, yah, i got it back, the diaphragm was ruptured, i didn't check it b4 i sold it to the kid so no way to tell how it got that way.

Wow! you didn't have to do it. No matter how much breath they wasted. You should have escorted them off of the property. If they didn't leave, a quick call to the police would have been the limit of your responsibility. You pay rent for or have your name on that property as recorded in the deed office. Next time don't let some one just walk on you property and take your money.

Yea i agree with everyone here on this one. I wouldnt of gave him his money back, its only $20!! not $200..if it was way more then $20, then i would be saying "yea give him his money back" i would do the same, but in this situation....."AS IS" sale...no refunds. Stupid punk kid.

Better that you did the right thing, instead of having a brick thrown through your windows or various acts of pathetic vandalism. Add in there the "looking over your back" feeling and have to worry about locking everything.
Next time you meet someone maybe sell them it somewhere away from your house.

do you really want to be known as the guy who sells cheap ass parts? NO, get with the kid, find out why he thinks its broken, and show him the appropriate way to install/utilize it. If its something that he bought and never needed tell him no refunds. People do need to know the hard way but not like the way other people are putting it. BE THE BIGGER PERSON!

I also am going to agree with viprez586. Despite the fact that it was used and sold as-is, you did the best thing by giving the money back. That $20 could have potentially saved you hundreds. When people can't get even legally, sadly, a lot will try to get even illegally. This is usually the case even if it's not your fault.

You did the 'easiest' thing for both parties by giving him a refund and taking back the part. Was it the right thing to do? Yes, but only if you sold him a bogus part, otherwise these men were just being man-b-----es.

If the wastegate worked as prescribed by the manufacturer then the diaphragm wouldnt be bad right? They dont just 'rupture' without any outside assistance. Why did you sell the WG anyhow?
