Transmission Band Broke

I bought an engine with transmission off of ebay and after we got it in the car the transmission would not shift into third. We took the tranny pan off and found a broken piece off of the band. What would cause the band to break?

Also I wonder if there is any recourse for me since the auction stated that everything was tested (although it says they will not cover labor). I believe it is not as described (lie) since he said it was all tested.
 
I do not know a whole lot about transmissions but he said it was the one that grips around a wheel to prevent the other one from moving so that it will go into the next gear. It is metal.
 
Transmission band is the band that goes around the planetary set in an automatic tranny. When it's time to shift, the selenoid engages the band to suddenly grab on the outboard ring gear of the planetary set to allow the power to pass through the planetary gears to the final drive shaft.

Prob how it broke is lack of fluid, fluid was extremely dirty, or was ready to break in the first place.

In short, tranny has to be rebuilt to put new shift bands in the unit.
