Anybody notice the white paint smeared on the truck's rear tire? -Looks like the guy was trying to do the run part of a hit and run when he realized he was stuck and there were probably witnesses. If the ass end of the spyder hadn't wedged itself under the truck and made a bunch of noise, I'll bet he would've ran and you'd have found the car in a heap with no idea wtf happened.
That driver probably just finished drinking his breakfast/lunch.
 
..............i don't know what to say. I don't live in the US but man try to fight this and try to get more then 6k. I have the same exact car white with black top, I don't know what I would do if I saw my car like that. I am so sorry!
 
I just cried a little, seriously. Fight that shit and get more than just a measly 6,000!

Sue the town or the company that runs the truck. They should be well insured for this sort of thing.
 
Well.. this is why I do not park near corners.

Too many damn people see a corner and go into Schumacher mode, no matter what they are driving (obviously.)

My apologies regarding the car. I would sue either the company or the city (if it's a municipal thing) for much more than the car is worth. Pride and Joy right there.

However, I'm going to play devils advocate. Well, given we can't see the damage on the drivers side, but from what I would expect in that incident, I'd bet 6K would cover repair of the car. Just because it got damaged, doesn't mean you're entitled to get it totaled and full cost of the car in cash. They will repair it if possible. Likely, 6K covers it.

Did your insurance company total it?

There is no way 6 grand would cover all that damage. Paint, the bumper, spoiler, tail lights, suspension, axles, wheels, the quarter panel, possibly a ripped top. That's not going to be cheap.

I agree with steve. No way 6 grand will cover it. I am willing to bet that much wieght on the rear portion of the frame probably bent it.

However, I recently saw a case were a plantiff was suing a defendant. The plantiff claimed that the insurance company paid for the to be total. The plantiff claimed that it is not his fault the car was damaged (car was parked), and since the full liability is at the fault of the defendant, then the defendant is responsibile for all costs above the payout. The judge ruled in favor of the defendant, the defendant had to pay for the cost of the buy back from the insurnace company PLUS the costs to complete the repair. I don't remember the numbers, but here is a example so you get an idea. He also got money for a rental while it's being fixed.

Car KBB = 6000.
Buy back = $500.
Cost of full repair = $12000.
Judgement = $6500 + Court Costs and a later appearance to reemburse all costs incurred by for the Rental.

Now the insurance company SHOULD pay for it all, but that's only if his/her coverage is more then $12500 per vehilce per incident.
 
The only way you can fight this is what was previously stated. You HAVE to get your car appraised from an insurance rep, if your car was modded by any shop I suggest you call them and have them fax you all the receipts from your car, then you mail it to your insurance company and they'll come up with the value your car is worth. If you did the labor, you can either have some one appraise your car like an insurance rep or whoever would be certified to do that, OR you bring your car to a shop that knows what they're doing and have them make a list of everything on your car aftermarket that will raise the value of the car and print up a receipt and send that to the company. Hope that helps and I hope you can fight these jerks and get what your cars worth.
 
Wow that's just horroble. Just another thought, I don't know if people have sold these before, but if you can find what price an AWD Spyder sold for you might be able to use that to show them. I assume it would be pretty high.

Whats with the red paint smeered on the rear right side?? And it looks like the truck reversed before the pic was taken? Why else would their be white paint on his rear tire if it's behind the car??
 
Wow. I didn't know that this was moved to a completely new thread. Nor did I know that there were so many replies.

Here's the lowdown:
City offered $6100.
Minus $1100 for the car salvage buyback.

So, I'm up sh1t creek.

So, here's what I think I'm going to do.

1) Retain counsel. I had one previous Eclipse Spyder GST (6-bolt, GT30) that was rear ended by a college girl on a cell phone. I was stopped. She was doing 45. A truck traveling behind her creamed us too and knocked me and my wife unconscious... long story... I have pictures. I guess I'll use that lawyer.

2) Get an INTELLIGENT appraiser. I apparently need two... Does anyone have a suggestion in the Houston area? I live in College Station. I have called around, but I seem to only find normal run-of-the-mill morons.

3) Um... spend time working on my Fiero or 240 I guess.

What the hell, guys? Why does it have to be so HARD???
 
Was your car insured for all those parts in your car. When i told me insurance agent that i would be modifying my car. He said to let him have a detailed list of what is done to it just in case for the worst. This being one of those times. If not, than they would not help me if i had to fix those parts that were broken because its not stock. But i dont know if you cant use that in the court. Hopefully everything works out correctly. Get a good lawyer though. A good lawyer that knows the judge. :thumb: Thats what i did.

I have not found a competent adjuster yet and have not contacted my lawyer, but I have gotten a statement from RRE and have found an advocate who knows people who work in high places in the city. All I want is for them to double their offer. $12k is reasonable.

My car was not insured for the modifications. I was not finished, so I had not had the value re-assessed. My Datsun 1600 and 240Z have, though. but they are being stored and are insured as classics.
 
go to a reputable hotrod shop, custom car place what ever.. get a quote for a custom AWD drive train install (parts and labour)

talk to a lawyer take this info with you, and hopefully you can get some more money out of this.
 
Check out Htown-DSM, it's the local Houston DSM board. There should be someone on there that can help you out finding a good appraiser. Good guys on there.

Not sure if you can get back information from ebay, but an AWD spyder with a claimed 300 WHP sold last year (maybe year before) for about 15k.

But really, I sympathize for you and your situation. Sorry about the bad luck.
 
How fast was the truck going to make your car turn and end up from the driveway....then the grass. Thats the stupidest ####ing thing i have ever seen from a person driving. It looks like it almost ran the car clean over but couldent get up the back. Well you can always do like i have seen at my valet job. A kid i worked with took a gt1 out of the garage he just learned how to drive standard and i let him have this one cause i had a lambo before. He slams the gas and pushes in the clutch when "trying" to stop and slams clean into a tarus gl. The man with the car walks up calmly and strangles the kid to his kness in the parking lot screaming he will kill him then while the car is rolling back he throws him behind it. Now we dont have to pay for a gt1 atleast cause cameras got it all on tape.
