A little long, but an unbelievable story.

My friend and I searched and searched for over a year for a 1992 Z28, low miles, excellent condition inside and out, near stock, fair price. As easy as this may sound, it wasn't. We finally found one in Wisconsin (we live in Texas), and got a trailer ready to make the trip when the guy selling it decided last minute to sell it to someone local. So, frustrated and ready to take a huge road trip, we got lucky and found one in New Jersey, 25 hour drive each way. My wife is going to have a baby any day now so I had to stay behind, and Scott (my friend who bought the car), his girlfriend and her brother left just this past Friday.

They get to New Jersey and pick up the car. It's in better condition than the seller even let on, and it was a great deal. Very, very excited, they leave right away to return back to Texas. Just an hour and a half later, in Maryland, they get pulled over for "crossing a solid white line" with the trailer while making a turn.

The conversation proceeded as follows:

Cop: Got any mariuana?
Scott: No sir.
Cop: Any cocaine?
Scott: No sir.
Cop: Any heroine?
Scott: No sir.
Cop: Anything at all that I'm leaving out that may be considered illegal?
Scott: No sir. But I do want to be upfront with you and let you know that I carry a current Texas Handgun License and I have a handgun in the truck.
Cop: Can I see it?
Scott: Yes sir. Here's my handgun license, and the gun is in the glovebox. I would rather you go get the gun out of the glovebox yourself if you don't mind.
Cop: Thank you, I will.

Cop gets the gun, takes it back to his car, gets back out and puts handcuffs on all 3 of them and makes them lay on the ground. 4 other cop cars show up, Scott gets put in the back of one. DRUG DOGS show up. They search and search, and the dogs are showing NO signs of anything amiss. The cops proceed to make the drug dogs jump up on the hood of the Z28 they just picked up and walk all over the car! :barf:

Still, no signs of any drugs, but the cops insist on tearing the entire truck apart, speaker box, seats, everything. Then they have the drug dogs get back up on the Camaro and search some more, scratching it yet even more.

Then, they haul Scott off to jail. WTF?!?! So there's Scott's girlfriend and brother, sitting there on the side of the road having to put the truck back together, trying to figure out what the hell to do next.

Long story short, Scott stayed in jail until 9:00 that night, got bailed out with $5,000 wired to Maryland by his parents, has to re-appear in Maryland on Sept. 19 for court, where he will get a minimum 30 days in jail.

Has our country just gone absolutely totally mad? Ok, ok... I know. It's illegal to have a gun in Maryland. But in Texas, it's perfectly legal. Scott has no prior convictions and was as cooperative as could possibly be. Even after explaining that the reason he had it was because it's just always in his truck and also driving across the United States with his girlfriend and $7,000 in CASH makes him feel a little uneasy.

IMO, this cop was an absolute prick. This was VERY unprofessional. As a law enforcement agent, it is his job to be able to decide what proper actions he should take. Scott's honesty and forth-coming cost him 30 days in a Maryland prison, at least $5,000, hours and hours of travel time, expenses in travel, and not to mention a scratched-to-hell Camaro that took a year to find in perfect condition.

To me, this is like pulling over an 80 year old lady because she was going 57 in a 55, pulling her out of the car, beating her down because hey, she might have a weapon. And hey, I guess since technically she broke the law, she deserves every bit of it.

Scott did manage to point out to his lawyer, who resides in Baltimore, that yes, while Texas allows the carrying of a handgun and Maryland doesn't, it's a little ironic that Baltimore currently has the highest murder rate in the United States! Seems to me that the cops there are barking up the wrong tree. If this is the kind of crap you guys up north have to deal with, DAMN do I feel sorry for you guys. It's like a whole other country up there!

The lawyer is excited to take Scott's case for reasons that I can't explain just yet but you probably have an idea as to what they might be. :cool:
 
keep us posted on what happened. That sucks man, i feel bad for the guy and the car. I used to have a 89 camaro...3rd gens were always my favorite. Oh yah. there is always good cops and bad cops. I like the fact that alot of them are nice and actually are productive. The other side is alot are pricks, judgemental, and completely rude....they arent above the law but everyone seems to turn their head....whatever tho...
 
LOL crossing a white solid line with the trailer? give me a freakin break. I touch the solid lines all the time when I turn and I don't have a trailer attached and I never get any crap for it. I mean is that really a traffic violation?
 
Jesus christ, this is why my father doesnt want me going into the criminal justice field. My reputation is already waiting for me.

thats just a whole bunch of major bullshit. someone should get fired and someone else should get his money back and a new paint job.
 
Sadly, the violation was undoubtedly driving in Maryland with Texas plates. But the white line dodge shows you that if a cop decides to stop you, he will.
As for the sense of carrying a gun outside the state that issued the permit.... well. But it gave the locals the leverage they needed to rape him with. Good luck on recovering damages, especially from Texas. Ask the lawyer if he has a civil case for harassment or the like.

the cops are getting really stupid. They are going to keep screwing with the populous until the populous takes the attitude of "why bother even stopping for them. even if Im innocent I'm still going to go to jail". I think we'll be seeing a lot more high speed pursuits in the future. I have no respect for the police because I look at them the way they look at me. The cop has to earn my respect. Hope you kick the crap out them in court. good luck.

That sucks, but.. what happened to the car?
 
We do have the right to bare arms. And if he is licensed, it obviously means he can handle the responsibility.



I would at least want an explanation and an apology for the car.

I see a lawsuit coming...

And a person in that reguard can only be held liable for the area of which they are a resident.
Afterall, when you drive your car to a different area that has different laws, your car is not subject to those "foriegn" laws.
A person with a CCW permit in one area is recognized as legal in all 50 states, reguardless of local laws.

The multiple drug searches by the dogs with -0- result did not justify the continued search -WITHOUT REASONABLE CIRCUMSTANCES/ IE PROBABLE CAUSE- and definately did not justify the "destruction" of the vehicles interior for furthur searches with -0- result.

GOOD GOD PEOPLE, JUST SAY NO. IF THEY HAVE PROBABLE CAUSE, THEN THEY CAN SEARCH, WITHOUT IT, TELL THEM TO TAKE LEAP OFF A CLIFF.

When you refuse to give them permission, they cannot do so without some outstanding VISABLE evidence.
IF THEY push the issue, you advise them that you will pursue legal actions. If they do search without probable cause, that is an instant law suit.
 
The comment about the CCW permit being "legal" in all 50 staes is not correct. I have my Florida CCW permit and i am only legal to carry a weapon in something along the lines of 36 states. And to my knowledge there are no states that are legal to carry in all other states.....Have Fun

legal and recognised are two different things. If you take up residence in that state that CCW's are not avail... then it becomes invalid. But a "passing" driver is ok.

I was stationed in JAX and had freinds that transported very large caliber rifles throught he southern states to VA. They got stopped in VA, and the tropper had a cow. He showed the CCW and firearms license, no to mention the military ID and the tropper dropped it.
 
Excuse my last post, somewhere i got to thinking "carrying" the gun on your person, not having it in the car. My bad

But ya, either way the cops went WAY to far.
 
To add one more thing, if all this was happening to me, I would have immediately demanded to speak with that officers Sergeant.
I believe when asked this the officer has no choice but to call his superior to the scene, not his crew of flunkies.
 
The Police will more then likely lose the lawsuit. If you do not get major punitive damages, you should at least seek compensatory damages. They were way out of line.
 
so what was the charges he got arrested for? i doubt it was because he crossed the white line? or carrying a handgun into different state? or did they arressest him to get their arrest quota up? i highly doubt that. they cant arrest you without charging you for somthing? so what was it?

Alright, I'll try to address everyone's questions/comments thus far.

He got arrested for carrying a weapon. Crossing the double white lines was just an excuse to pull him over. His lawyer here in Texas says that up there, if they see Texas plates, they will do whatever they can to cause trouble. He said the reason they searched so hard for drugs was because he was from Texas, and lots of drugs come in through Texas from Mexico. Scott said that the cop was also suspicious because Scott's gun was "so big". It was a .45. The cop was like, "why do you need such a big gun, huh?" Turns out I'm sure he was jealous because his was smaller.

Give me a break. So, if I say I suspect you have drugs because you're black, that's prejudice. But if I suspect you have drugs because you're from Texas, that's fine. :rolleyes:

The reason he didn't refuse a search, ask to speak to his sargeant, etc. is because he was being as polite and cooperative as he could possibly be.

Scott is just beginning the lawyer process. He thinks that he might be able to reduce the 30+ days mandatory imprisonment to 30+ days in-home probation. No word yet on what they plan to do about Lassie's scratches on the hood.

Defiant - I'm not stretching the truth, leaving anything out, etc. These are the facts, for real. As I said at the beginning, it's absolutely insane, unbelievable.
