OK i'm not going to explain the hole night but it was a bad one. charges started as
OWI, Felony eluding, 100 in a 55, running a stop sign.
Now the owi i proved i was under .08 and was lowered to 02 violation, the felony then dropped to aggravated misnomer eluding. It looks like the eluding will also be dropped due to the officer having unclear report and lying on the report. My problem still stands with my 100 in a 55. What is the usual penalty for that ticket? I already served my time for the o2 and have my lisence back we stalled this for about 4 months. Anyone have any ideas? O and yes it was a very bad night and very dumb move on my part bash away if you feel necessary but helpful information would be more liked:) Also the officer did not clock me he said he was judging off of his speed witch in the report says sped up to 100mph yet it says he was never within a few miles of me.

I'm in Iowa and I got pulled over and ticketed for 90 in a 40, although I was going much faster than 90 and in a 55 zone but whatever. I was 18 and dumb.

I can't tell you much about the owi or anything.

To start out i had a COMPLETELY clean record up to this point.

However for my 90 in a 40 which was 50mph over, I received a $180 ticket that I payed online which automatically is an admission of guilt. Maybe I should of fought it, maybe not.. Either way my situation turned out okay.

I was ticketed on feb 8th 2009 and payed my ticket the next day online. March 16th I received a letter notifying me I would lose my license for 1 year and afterwards be placed on 1 year probation where if I got another ticket I'd lose it again for another 6 months. It had an option for me to send an appeal letter or a form for a work/school permit.

I appealed it and got a letter 3 weeks later saying my appeal had been accepted. It then requested a written letter of my appeal with an explanation of why my license suspension should be overturned and why I needed to keep it.

I wrote about a 3 page letter saying I know what I did was wrong, and that I needed my license due to being a min wage worker trying to go to school and since I am the primary driver for my family, which I generally am. I asked for a reduction in the time of my suspension but I understood if it wasn't given and I accepted full responsibility.

Late april I got a letter back saying I could keep my license if I took and passed a one day class. The class cost me $90, and 8 hours on a Saturday during the summer.

So in the end, I payed $270 for my 90 in a 40 ticket, spent 8 hours in a class. Then after that I was on probation for a year where if I got one ticket I lost my license for the full year.

Honestly it turned out better in my opinion than the people who pay a layer $700 to get time reduced, or just a much smaller ticket where they only pay a fine.

I also lucked out that my insurance NEVER went up from my ticket, which amazed me. Every time my insurance statement came I expected to be dropped or my rates super high.

I haven't had a ticket since. Not to say I haven't done a few things I can't talk about on the site here since then, however I'm MUCH smarter about how I drive. I definitely learned a lesson about it. Prior to getting my ticket I drove like a complete dumbass everywhere I went.

If you have any more questions feel free to ask me here or PM me. I did a lot of researching when this happened to me.

My cousin and a couple friends were ticketed doing 25 over (including a 110 in a 60 & drinking and speeding). They were fined and lost their licenses and my cousin went to jail. Here in NE I took a class ($100) so I wouldn't have to go to court and pay the fine (+$150) is there anything like that in IA? But by the looks of it at the least a fine/ticket or the worst fine/ticket, probation, license taken away, jailtime or all of the above. Just depends if you get a cool judge that will let it slide with just a fine or be a d*ck about it and send you to jail. I've seen people go to jail for a simple speeding ticket and some getting a small fine ($75 bucks) for no insurance (I've been to court many times for myself and for family & friends so yeah :p) If you really feel its that bad then get a lawyer. I would recommend a good lawyer if you can't afford to spend time sitting in jail or you feel you can win. God luck man :thumb:

I believe here in Iowa anytime you get caught 25 over you loose your license unless you appeal.

I had the the same thing happen as clinical except I got 3 tickets in a year I was 17, I appealed took a class and was on probation for 6 months.
the classes and the fines suck but the added insurance rates continue to bone you for years. I've had a clean record aside from a 7 over ticket 2 years ago before that I hadn't had a ticket in 5a years.

Good luck you will loose your license hopefully you can appeal it and learn your lesson.

i have a great attourny and i am going to appeal the ticket sence i already appealed and beat the owi and my eluding was dropped to lesser charge.

If he didn't have you on radar, your lawyer ought to be able to get it fixed for you. I had a 40 over ticket here in Illinois. That's a class A misdemeanor, same as a DUI. I paid a lawyer $500 to get it reduced down to a 65 in a 55, and paid a $650 fine. I had a pretty bad record when I got it, so I would have probably lost my license for 2 years over that. I ended up paying $1150 total, with no supervision or anything, so I can't complain, my insurance didn't even go up. Over the next few months I accumulated a 70 in a 55, a 80 in a 55, and a DUI. I paid $4700 total in lawyer fees and fines, lost my license for 90 days, but received no convictions on any of that. That was in 08, haven't had a ticket since, my insurance is cheap as ever.

Moral of the story, pay a good lawyer to keep your ass out of jail/license suspension.

No. Moral of the story is don't drive like a kid who just watched FnF.

Why do people have to come in these threads to lecture? Seriously, he knows what he did is wrong and admitted it. If he wasn't accepting the consequences for it then that'd be another thing if he was trying to shift blame or something.

Yes he was stupid and an idiot for doing what he did, but whats done is done. He isn't bragging about it.
He's simply asking for advice for his legal situation. If you don't have anything worthwhile to attribute then don't post. He's going to probably have enough legal consequences that he doesn't need you to babysit him.

Now to the Op: I'm serious when I say let me know if you need any information on traffic laws or such. Although your attourney should be able to do most of that for you. On my laptop I have bookmarked all of Iowa's traffic laws and code. If you wish to do any personal research.

bastarddsm isn't the OP. He didn't ask for any advice. In his last sentence he made a statement of how the problem(getting your ass in jail) can be remedied. I also posted a way that the problem(getting your ass in jail) can be remedied.

Usually unless you quote the person you're speaking to, its going to be pretty much assumed you're speaking to the op.

i suppose if i was trying to be fast and furious i would have been driving the eclipse right??? to bad was my truck... aswell as i do not race on the street that does not change the fact what i did was reckless but bringing up the F and F really? besides the fact to both guys who posted this my truck would beat your cars at the strip let alone it will beat my own gsx.:)

depends on whats done to it my cummins got 2nd place in performance 4wd truck at lacrosse street drags up by were i live. and it just dynoed the other day at 553whp on just a 100hp tune still have a 200 RKL tune i could run.

I only had 1 speeding ticket, and i got caught going 95 in a 55. I explained to the cop saying i was late to my high school graduation and he knew i wasn't lying because he saw my cap and gown in the back seat. He still gave me a ticket as going 75 in a 55. Here in NC it is mandatory that if you get caught going 21 above speed limit you have to take a class. Since he wrote down i was just going 20 over, i didn't have to take the class:hellyeah:...i got a lawyer and only payed $280 and that's including the ticket, also no points added to my license and didn't affect my insurance at all neither:thumb:

hahaha very true, another moral is if you get caught speeding, get caught by a kool cop

well just talked to the district attorney and they are willing to drop the eluding charge if i plead guilty to the speeding, running a stop sign, and i guess s illegal passing charge witch i was unaware of until now. so im trying to see what i can do about the speeding if there is anyway i can if lowered or anything sense it will be auto 1 year no license for that. Might be less time loosing license if i plead guilty to the eluding over the other 3 charges kinda sad imo.
