private party sales question

so recently i traded a bike i had for a 91 laser awd. the car was out of state. the kid i swapped knew i didnt have the title for my bike but i told him i was gonna try and get it for him. i told him he could keep the title for the car until i was able to get the one for the bike. well i dont need a title in my state to register the car so i did already and its been a week. its not looking like im gonna be able to get the title for the bike. the kid is telling me he wants the car back or a title to the bike.... but ive already put 1100 into the laser to get it on the road.. legally what should i do here? i told the kid straight up i was gonna try to get the title because the bike was never registered to me. he doesnt have my address or my name just my cell phone number. let me know guys if i have to give this car back im gonna be pissed ### i drove 6 hours to get it
 
You never should have made the trade in the first place.

You put money into a car you dont legally own, and if you expect anyone here to suggest you screw this kid over and essentially steal his car then you'll be surprised.

What's the problem with the title for the bike?
 
he told me take the car, and ive tried to get him the title, i bought the bike from a friend who had the title.. however he never registered the bike he just let it sit. after i bought the bike off him he couldnt find the title for it (he lost it somehow) i drove it all season on a dealer plate i didnt rlly car. but in order for me to order a title for the bike i need the last registered owner because if i buy one online its gonna get sent to the last owners address which i dont have. ive i could get that i have no issue at all getting the title for the kid. but he knew the deal going in i said i have to get a hold of the last registered owner. but my question is legally worst case scenario since its registered to me what can happen? i have a legit bill of sale. im not trying to screw anyone ill do whatever i can to help him
 
If you never promised the kid a title then its his fault.

I bought my eclipse with no title and made the owner sign a note at the end of the bill of sale saying I can get a refund if I don't get a title within 2 months.
 
I think being that you told him that you could possibly obtain a title than he fully expected you to. The bike without a title is pretty much worth 500 bucks. If you would of told him that you can't get one, it isn't going to happen and he still did the trade than he would be sol. I think that you should do all that you can to find the previous owner or get a bonded title on the bike and hold up to your part of the deal.
 
im gonn try like hell, but lets just say he reports it stolen or somethin, since its registered to me and i have a bill of sale what would happen? i bought the car with a rod knock, blown turbo, broken bolts everywhere, bad axles, no exhaust so the car was probably worth like 300. he told me all it needed was an oil pan and a starter..... the only good thing about the car was it has 3/4 tank of gas in it LOL because if i have to give it back or whatever he is gonna turn around and sell it top dollar running and driving needs nothing and when i bought it i had to trailer it home 5 hours like wtf...

PS Bonded title??
 
You put it out there that you could possibly get a title, so its on you.

You may have a bill of sale, but you cant sell something you dont legally own, so in my mind that makes that "legit" bill of sale, just a piece of paper.

Give the kid some cash for the car, or give it back. If you want to try, see if he'll reimburse you for the money spent on it to get it drivable. If not your SOL.
 
I get the feeling we have half the story. Why else would you say he does not have my name address etc? If you have a bill of sale then you should be good there. Only you know the story and if you did some thing shady karma is a real bi*** man. I am not saying you did or didnt for the record nor will I ever no.
 
im not trying to be shady. im being straight up all im saying is i told the kid i never had the bike in my name, im gonna try and get a hold of the previous owner and order the title he said ok i said if it makes you feel better you can hang onto the title for the car (Knowing i didnt need one to register it) i left him the bike (03 GSXR 750) which ran and drove mint. the car had to be pushed onto the trailer didnt run, he told me all it needs is a starter and the oil pan has a hole in it and an exhaust.. needless to say it needed alot more. so i towed it home 5 hours spent 250 in gas, put it up on the lift and was like wtf.... but i guess the condition of the car is irrelavant, so ive been trying to figure out how to get a hold of the previous owner so i can get their number call them and tell them im having the title sent to their house but i can figure out how.. im just pissed that the kid kind of screwed me on the car.. id help him if i could figure out how to contact the previous owner.. im mainly asking for my own knowledge. if it came to a legal situation since its registered to me, and i have a bill of sale that says nothing about titles what would the outcome be?
 
Right there man that is shady stuff. Your saying yea man keep the title, while saying to yourself sucker I will just register this any way!! Wtf do you know see that is shady? Did you tell the kid with the car you could register it with out a title? I bet you did not did you? What if the bike is stolen or some thing? I mean that is an expensive bike to just loose a title? Just throwing stuff out there.. Not saying it is.
 
So you told him that he could keep the title as collateral for the bike title knowing that you could get it titled and registered with a bill of sale. That sounds shady in my book. By the way, a bonded title is a title obtained from a title company. It usually cost's between 200 and 400 dollars.

HAHA see my post above yours that is shady as it gets, and is borderline theft in my book.
 
I'd say try as much to get the title for him. I wouldn't say it's shady, but in general, when selling something the recipient of the goods assumes a title will come with it, specially if one is given from his side on a trade. As for the condition of the car, that's a entity on it's own.
 
You, the buyer of said Plymouth Laser, are in no obligation by law to return the car, as it is legally titled in your name as of when said posted thread says. There was no said contracts, notaries, or notes signed by both parties requiring you to present Motorcycle title with the trade or the Plymouth Laser must be returned to said seller if title is never delivered.

You both had a verbal agreement on trading your assets with the Motorcycle not having a title. Both agreed. You did not promise you will get the title, you only said I will try to get it for him.

You can think of it being shady but in he was faithful in saying he does not have the title for the motorcycle and only said he will try to get the title. IMO I do not think of it being shady at all.
 
thanks for all your input guys. im gonna go down to the registry tommoro and explain the situation and see how far i get.. if not idk maybe ill see if he wants to split a bonded title because im not spending another 400.. im doing everything i can to make this right i feel like the fact that he mislead me on the car should justify me asking him to split the difference with me.
 
ya jus suckd i had to

-replace crankshaft
-Resurface head
-Balance shaft bearings were gone so had to do the eliminator kit
-rebuild engine (Rings,Bearings,gaskets,seals etc...)
-remove 3 broken header bolts
-remove 4 broken valve cover bolts (had to retap the holes)
*-remove broken carrier bearing bolts
*-replace oil pan
*-replace starter
-clutch was smoked (he told me it was done when the motor was rebuilt)
-flywheel was warped had to have it resurfaced
-throw out bearing was shot
-wiring harness was all melted at alternator (bought new connector and soldered it)
-idle sensor was junk
-2 injectors were clogged (had to bench clean them)
-rear strut was bent
-front subframe was cracked (had it reinforced and welded)
*-Axle boot was ripped (Replaced it)
-Drivers wheel bearing was shot
*-battery was junk
-timing belt showed signs of cracking so had to replace it (he told me he had it done recently...)

Not to mention all the vacuum hoses i had to replace, fluids, hours of powerwashing all the filth, detailing the car, and hours and hours of labor...

the kid told me he had the motor rebuilt recently.... from what that motor looked like it had never been out of the car.. i looked at it at night and took his word for it because i was excited to get another dsm.... my Bad i guess

the things with the * next to it is what he told me it needed....

x2 Not giving the kid your name or any other information other than your number and making this kind of deal..that's shady in my book.

But going half on the cost sounds pretty fair to me. Hopefully the kid feels the same way.
 
I'd say you're even. You were actually lied to about the condition of the vehicle and had to put in more money to fix it. He knew it didn't have a title and was never promised one, so its only fair that he spends more.

And even if he was your neighbor, he couldn't legally do anything.
