I was just wondering.. If i get a 3" cat. will that a risk of failing emission compared to my stock cat?

Yes. Aftermarket cats (high flow/Catco) tend not to last more than 2 years. Keep your stock cat, and if it's still functional, put it in for emission testing. Watch out for the visual inspection too. Some are more strict than others.
