Help...Please Read! Should I sue

ok my ball joint nut came off making my Talon fall into the ground ####ing up fender, bumper, and tie-rod plus more they said. There going to fix my balljoint for free but what about the rest. Who is liable please help and some facts to prove to them :talon:

There is a recall on that particular arm BUT it does NOT cover the arm should the nut back off. The recall specifically mentions failure of the ball joint itself and has nothing to do with the nut that holds it in place.

Has someone recently worked on the car?

And just because something happened to you doesn't mean you get to sue someone else. This nut doesn't just fall off. It has to back off 3/4 " worth of threads. Did you not hear any clunking as you hit bumps prior to this falling off????
 
If no-one has worked on the car, then I'd say that the owner was liable. They're only offering to replace the lower lateral arm (complete with a new ball joint) because of the recall. You can, of course, sue anyone you want (including me), but you will probably lose. You might not have had any warning that the nut was gone because the post on the ball joint could have stayed wedged in place for a while before suddenly letting go. Just chalk it up to experience, thank whatever or whomever you wish that you weren't killed, and move on.

With that said, I have to say that it's a bummer.
