Transfer case replacement update from dealer

Well, my car has been at the Chrysler/Mitsubishi dealer since last friday. I took it in because my transfer case leaked all the fluid out, and left a nice trail behind me. I hauled it up there, dropped it off. They said it would be tuesday before they could look at it. Well, they looked at it, and I called them, and they said that they were "waiting on permission from Chrysler to replace it." Ok, sounds good i guess. Then he said that he didnt think that it could be done because #1, it had been performed in Aug. 1998, #2, the car has a prior salvage title. <---car got hit in the front and set the airbags off before i bought it, it really only did minor damage. But anyway, i said ok, and i waited. Today, I call them, and he says "I was just talkin about your car, My district service manager was in here today, and she thinks it should be done. But its still up in the air because we are waiting on Chrysler to decide." So, if their district service manager thinks it should be covered by the recall, can Chrysler really do anything? I mean, isnt it a federal safety recall or somethin?

Oh yeah, i've read the huge posts on the transfer case recall, that's how i knew to take it to them in the first place. I dont want you to get the idea that I don't use the search function, as I do. I was just giving an update to a post that I made before I took my car into the shop. So many times on here, people leave you hanging with what's happening, and I just wanted to let everyone that's considering this know how it's going, at least for me anyway... AND, i just needed to ramble and get that off my chest... haha

OK, here's what the dealer told me this morning. "Chrysler has fulfilled their duty by replacing the transfer case once, in Aug. 1998. In Feb. of 2002, the car was involved in an accident, which gave it a salvage title, so we cannot fix the car under the recall."
Now, the car just has a "Prior Salavage" title, it's been inspected and proven to be OK, all that happened in the accident was a car hit it in the front left fender, and kinda the front, which popped the airbags. It was only cosmetic damages other than the airbags. Should I call the chrysler number, or just call the NHTSA? I think the dealer is full of crap by saying that.

call NHSTA, stop f'ing around with the dealer. If they say that it isn't covered becaue of a salvage title then okay, but more than likely satan is just trying to save money and is about to get a nasty note.
 
The dealership here wouldn't do mine. They stated that the engine and drivetrain have been tampered with (I have the jdm GVR4 engine/tranny, but they don't know that). Anything I can do about this? or am I just shat out of luck?
 
Well guys, I finally got it sorted out. I called the Chrysler Recall center and spoke to a guy there. Come to find out, the dealer NEVER even contacted chrysler for approval. They were just messing with me. I didnt take to kindly to that. The guy at the Recall Center said that no matter how many times it had been replace, it will HAVE to be replaced again. He called the dealership, and guess what? Within 30 minutes I got a phone call from the dealership saying that it was being tore apart as we speak, and he has most of his guys on it right now trying to get it taken care of. That's more like it. I told them as soon as it gets done, i'm taking it to a reputable mechanic to have it looked over, just to make sure they know what they're doing. If anything's screwed up because of them, I'll take it to my lawyer. They flat out lied to me by saying that they were waiting on an approval from Chrysler, and keeping my car for a week without doing anything to it. That pisses me off. Now they know that.
Anyway, i'll let you guys know what happens after it gets fixed.
For those of you that had your dealer say that it couldnt be done, GO ABOVE THEM. The dealerships are out to screw you, dont let them do it.
