whos liability

so i was goin on vacation so i take my car up to get a new clutch and the front seal repaired. when i get back i find out that while it was on the dealers lot (the used car dealer i bought it from was gettin us the hookup on a cheaper repair...i only bought the car a few months ago) someone broke out all the windows and windshields and stole my stereo. now when we drove it up there i asked him if i needed to remove everything and he said take the faceplate everything should be safe though. now is that a verbal contract? he said he will prolly replace the windows but not the stereo and its like an $800 stereo. so its worth fightin for if he needs to pay for it. i didnt sign anything like a waiver or nething. so whats your opinions on this.

Many shops have a sign posted somewhere that says "Not liable for any stolen or damaged goods", or something to that effect. If there is a sign like that you are pretty much screwed, if not, then you might have a case worth pursuing. If you have stereo equipment that expensive I would make sure to have comprehensive coverage with a low deductable of about $100 for when those things happen. Good luck

i know of this lawyer service... it's $35 up front then $25 / month... but everything's covered... they're really high rated lawyers and it's a prepaid service... they take care of traffic tickets too!!!!! well worth the 25 each month for me!!! and it's all over the country!!!

in my opinion, they should liable for anything whether there is a sign posted or not. one thing ive learned about dealerships is that most people that rip off things from cars on the lot, actually work there. get the police involved and get finger prints and demand they investigate everyone at the dealship.

once you threaten the dealship with that idea, more than likely they will be kind enough to ask you not to and replace anything that needs to be replaced. they don't need a bad rep like that. even if it turns out that they aren't to blame at all, people will still get a negative impression if they hear about it.. a dealship certainly doesn't want that.

If there is a posted sign saying that they cannot be held Liable for any type of damage that occured to your car while on their lot, you cannot come back on them. James had a good suggestion. Get the police involved. How long ago did this happen? Is the car still on the lot? Have a lot of people touched your car since? I doubt that they will do a full blown investigation for stolen goods, but at least you have the report for your insurance company.
