I sold my gsx this weekend. While driving it to his house the guy who bought it managed to break numerous things. His mechanic said it was because the fan switch didnt work well. Apparently the temp shot up and a hole developed in the valve cover (already minorly cracked) thats all he knows. Now he is trying to get me to pay for the $1500 in repairs (according to his mechanic, I think it can be fixed for $400). I feel bad as he just bought the car but it was fine while I owned it and I was completely honest about all the problems it had. What do you guys think? Is it my reponsibility to help pay for?
 
Next time you sell a used vehicle, make sure you write "SOLD AS IS" at the top of the bill of sale.

Shit happens, I hope for your sake he doesn't try to take you to court over this, what a mess that will be. :toobad:
 
I thought about it and I dont see how he could win in court, he was a nice enough guy which is why its so unfortunate. I just cant afford to help him out. Wouldn't it be assumed the car is sold as is if not written statement of warrentee is given?
 
Not if he wants to argue that the warranty agreement was verbal. People are weird, they will seem nice then turn totaly anal at the flip of a switch. I sold a dirtbike to guy, told him that he need to replace the piston and rings before ridding it, he didn't and ended up wiping out the cylinder as well, then tried to con me into buying him a whole new top end. Just watch your back man, thats all I can say!!
 
I wouldn't lose sleep over it. Whenever you buy something used it is always assumed "as-is" so if he tries to take you to court and sue you for it, it will never hold up.
 
Considering a moron didn't pay attention the the stock temperature gauge rising, it's his own damn fault and neglect. I'm not really sure how rising coolant temperatures would create a hole in the valve cover(whether or not there was a crack to begin with) and how a hole in the valve cover would cause $1500 in repairs.

It sounds like this a$$hat is trying to take you for money. I would tell them to get over it, and if he wants to play hardball, consult a lawyer.
 
You have to be careful when selling something as "as is." It is a powerful term, but at the same time it can mean absolutely nothing. When you put "as is" don't also write the tranny is perfect, engine is perfect. Because if the new owner buys it and there is a freak problem with the engine, it will void the "as is" and you will be forced to pay for it.
 
yea i had a simular situation happen to me with a car but luckily the guy i dealt with was nice about it
 
Just be lucky that is all the current owner wants. My first eclipse gets passed around Northern Iowa like a prostitute. Every new owner seems to find MY phone number and calls ME for tech support and help?!?! I sold the car with 215,000 miles on it--of course it's going to break down! Its not like my phone number is written anywhere near the car, it just happens to get sold to idiots who don't know anything, so they call the previous owner. YAY! I should have crushed that car :rolleyes:
 
It won't hold up in court and I would feel bad to knowing it was fine untill it got ito someones hand and took a crap right after but things happen. Just let him know there is nothing you can do about it but if you wanna help him maybe point him into the right directions for parts. Anyone that owns a DSM really shouldn't take it to a shop or mechanic because it gets costly very quick. Good luck and like I said you may feel bad but if you told him what issues there was there isn't much you should do after the title is signed.
 
Thanks for the responses everyone. I no longer feel bad as he is now being an ass about everything. Title was under my mothers name and he is trying to say she didnt sign it (dont worry, she did.) and is threatening me with a lawsuit. I assume it will be ok, my boss is a partner is two HUGE law firms and would love to have a legal fight!
