will 17x8.5 +40 fit?

I'm thinking that the rear tires are going to rub the fenders, especially depending on your tire choice. I'm running EVO 9 wheels (on a 99 GSX) and they are 17 x 8 with a 38 offset. I have Dunlop sport maXX 245/40-17. I'm not quite sure how much the car is lowered...as far as a specific number of inches, I have Tein type flex and I want to guestimate that it's lowered around 1.75 to 2.0 inches and the rears hit the fender lips if I hit a dip in the road and more than 30 mph. I have the rear camber at -1.5˚I was dying to get 17 x 8.5 or 17 x 9 but could not find the perfect combination of wheels that I love, that fit, that I can afford.
