Well i got a 04 Acura RSX type s and for got all about my little dsm:dsm:...... Well i went out today to look at my motor, I had pulled the head off the car before i forgot about it.
Surface rust on the block and the oil return line has broke and all the oil leaked out. Think it is safe for me to take some sand paper and take the rust off? Then put the new head on and put the new oil return line on and run the car?

Are you talking about surface rust on the top of the block? Where the headgasket sits?
If so, I wouldnt take sandpaper to it, but you could use some veryfine scotchbrite. I did it before and it worked fine, just took ALOT of elbow grease.

I think you would be safe that way, only one way to tell.
