Tial 35mm wastegate

I bought a Tial 35mm from a member of this board and I have a few questions on it. While holding the base of the wg I can spin the top (piston spins with the top) freely. The 38mm's that I have seen are unable to do this. Has anyone else ever run into this? I took it apart and the spring and rubber seal look fine.
 
Mine does it as well. Though I've only been running it a few days now so I can't really tell you if it's normal or not. I was actually wondering the same thing.
 
I sent an email to Tial's tech dept so we'll see what they say. I'll post their response.
 
There is a nut and a small retaining hex-screw that just needed to be tightened to keep it from spinning. You can take it all apart and loosen that nut to rotate the cap in whatever way best fits your application. Let me know anyone needs more details on dissassembly.
