Rear diff help

OK so My rear diff leaks and i found the problem it looks to be a axle seal on the driver's side. Well my problem is The previous owner know's nothing absolutely nothing about car's. And he drove it leak and just filled the rear diff up when the gear's started to skip. That was his indicactor that the rear diff needed to be filled back up with more gear oil. So my question is, When the car's sitting still and i move it slowly (has no gear oil in the rear diff but im not driving it) the rear end gear's skipping a tooth or something i know this is stupid but i dont have my license right now so i cant drive it. But when i fix the rear end and its full off gear lube wouldnt that make the rear end do what its doing worse? Like the gear's skip worse? Please help i dont want to have to go in search of a new rear end.

If the gears are really slipping engagement you really don't have any choice but to rebuild or replace it.

Thier only slipping because it has no gear oil. But when i drove it back it was fine didnt have any issue's. I jsut talked to the guy and he said its not worth changing the rear axle oil seal because it's been replaced 4 time's already. Now i think he got ripped off and the dealership or wherever he took it told him they rplaced it. Because it doesnt look like its been replaced to me.

and its not slipping really. like The previous owner is saying just fill it back up and it will be fine. But before i do that Im going to replace the seal. There was no metal bits or anything that came out when i drained the diff.
