Car got HIT.... Looking for advice....

Well I came out of work today to find my drivers side rear quarter panel with a huge dent in it along with my rear bumper. I call the police and they fill out a report, but there is nothing I can really do except pay the deductable and get it fixed. Here is my question.... Can I take the car around and give the insurance company the most expensive quote, and then have it fixed somewhere else for less and keep the difference. My paint isnt in the best shape now anyways. So a decent paint job would be ok with me, cause I'm planning on getting the whole car repainted later anyways. Let me know if anyone has any experience with this... Thanks.

Is it legal, IE consitutes insurance fraud... certainly does.
When you get the estimate, ask them to do the whole car. Then they might do it, because...
1. It gets them extra insurance money
2. If the insurance company wants to complain, you are out of the bitching fest to insue.
 
Yes you can do it, no it's not fraud. They are obligated to let you have the work done at the shop of your choice, and to pay for the price of the work. That means you get a check, and you can slather Bondo on it and carve pretty pictures for all they care.
 
A lot of companies will at least require two quotes and will approve the cheaper of the two. Many companies will send an adjuster to the shop or your car and write an estimate of their own. If the shop goes over the estimate they have to deal with the insurance company to get more money. Some insurance companies will only write a check to the shop and not to you. I guess you'll have to read your policy or start the process and find out.
