Spyder Help please- mechanic changed timing belt, now engine is shot

As briefly as possible. *I admit I don't understand half of what I'm talking about - I'm telling what I believe to be true*

1997 Spyder GS with 140k on original timing belt. Took it to my regular Midas mechanics in NY (please no general Midas insults, the dealers were just as bad). They changed the timing belt [$1000] but afterward it was misfiring intermittently. Misfired worse at low RPMs. They changed the plugs and wires $300. They said it was old gas, it would clear, and it seemed to clear. Still had an intermittent misfire on cylinder 2. Drove 600 miles or so.
Car suddenly ran very rough, tach was jumping.

Towed to dealership, I was in VA. They found that Midas had allowed the crankshaft position sensor wire to rub the timing belt. It wore through the casing and shorted out. They replaced the timing belt and the CPS. Said slightly reduced compression in cylinder 2stoll some misfire, and recommended having coils changed when I got back to NY. $1200.

About 100 miles later in PA, car died on the highway, wouldn't restart. Dealership in PA said timing had jumped 6 teeth and found pieces of old belt inside the cover.

At this point the service manager told me they wouldn't know if there was more damage until the timing was reset. Reset the timing, scoped the cylinders, saw no damage, removed the lower cover and realized the balance belt had broken. Mechanic said the balance belt was very old and worn and looked like the original. He replaced the balance belt, then told me the car wouldn't start and they assume the engine is shot. $700.

Thoughts? Midas and the VA dealership changed the timing belt without changing the balance belt! Is that malpractice? I believe Midas will cover the $1200 for their CPS error. I could forgive Midas for not knowing to change the balance belt (they should have, of course). But the dealership certainly should not have known to replace the very old worn balance belt! Wouldn't they have seen the balance belt? It was 140k old and didn't last another 100 miles! Do they owe me a new car? Thoughts?

I know that what I ask for and what I'm going to get are not necessarily the same, but I am not sure what is reasonable for me to ask. I could replace my beloved Spyder for $2700. You gotta start somewhere.

The Midas offer is a start. I would not accept it without second opinions though. I would not trust a dealership blindly. Try contacting Jackson Auto Machine in Hanover MD (about 90 miles from your car). You may be able to make arrangements work out an agreement on how to proceed. Again, if any of the initial offers do not remedy your situation contact a lawyer. You should be able to get a free consultation & you should not have to pay for other mistakes & failures. Jackson Auto Machine (JAM) in the past was one of DSMTuners supporting vendors, a member of our forum, & offered custom turbo motor rebuild to our community. They are the closest I can think of & they would know how to fix your non-turbo motor the right way.

Mary - I live about 10 minutes from JAM (I'm on Fort Meade). Jerry is good people. He's a machine shop only, meaning he doesn't have a standard "shop" with lifts and the ability to pull engines. My engine is there now and I had to bring it to him out of the car.

Anyway, I would advise you to stay away from dealerships, or at least thinking that a dealership is somehow more qualified to touch your car. There is a misconception that "dealership" = "car neurosurgeon specialist." Not necessarily true, and often quite the opposite.

As to the judicial issue, there's good advice on here. I think you'll find that the dealership that wronged you will likely pay you back what you spent (or will fight it out with Midas). Neither Midas nor the dealership will want to pay the legal fees to fight you on it. It'll cost them way more than $2700 to fight you... easier to just cut you a check. But as has been advised, keep receipts, communications records, and make back-up copies. I would also advise you to journal everything as the memory and timelines fade and get fuzzy over time.

As to your car, any "decent" mechanic's shop can perform a compression test for you and tell you if there is damage to your engine. As has been said, if the car is in good condition (aside from the timing belt debacle), then you're better off holding on to it as finding one in good condition is getting harder and harder.

You can PM me if you want explanations on all of the mechanics jargon and whiz bang whosy whatsit stuff. Happy to educate you, especially as it will arm you so you can better deal with future "mechanics."

Wish I was closer to you; I'd help you get this resolved.
 
Well! I don’t t know what I would have done without your support guys, but I am happy to say Goldie is alive and well! Would you believe that the Maryland dearletship, Ourisman Mitsubishi of Laurel, retrieved my Spyder from the PA dealership, re-machined the heads, and put it all back together for me! It’s running like a top! Back in June, I broke down on the highway and Ourisman repaired the damage done Midas when Midas changed the timing belt in May. In June, Ourisman changed the timing belt again, but they didn’t change the balance belt, because they thought Midas did. So the balance belt went about 100 miles later. Ourisman took responsibility for their mistake and made my car right. They were amazing I just wanted to let you all know, because I would have given up without your advice. Thanks!

Finally some good news this year. I would find yourself a good mechanic and drive it forever. For what it's worth I've logged probably 500k miles over the years in several different cars. I've been at it nearly 30 years. They're reliable when treated well.

Sorry about your troubles and glad you were able to resolve them satisfactorily. I'm a bit late to this party, but, in case there are lingering liability issues, my review of my '92 Talon TSi's FSM shows the following in the Scheduled Maintenance Table for replacing a TB every 60k miles:

Timing Belt (Including the Balancer Belt) Replace
Trained and certified mechanics are supposed to follow the FSM, I believe, and they clearly didn't here. The FSM doesn't allow any room for doubt here, especially given how many miles your car had and that as far as you know neither had ever been replaced. A typical customer shouldn't be expected to know what a complete service job should entail, especially one this relatively complex.
