i would refuse to pay and let them know you will contact the BBB. A clutch fork cant freeze. It is just a metal fork in a rubber boot. So tell them to fix their errors or let you take your business else where.

I did, i also told them i am not paying...

They wont give me the car till i pay, and they wont work on it anymore because they are stuck...

At a loss here..

Its a reputable business, They guy working on my car told me he has been working on transmissions/clutches for 25 years and has never seen anything like this. They are supposedly the best place in down for clutch work too...

Like already mentioned above, tell them you will contact the BBB. When you take your car to an automotive shop, you would expect them to fix your problem not make it worse and still charge for their mistakes. Good luck.

What's bbb?

That's total bs. I would ask a cop wjats he this

Contacted BBB as stated above, if anything call the police and go reclaim your property. You shouldn't pay for something they messed up, specially since the car was moving its own power before you took it in. They say they're a "reputable business" but that's some really shady business, even if they offer to try and fix it, I'd just get it towed and find someone else to do the job.

I am going back over there tomorrow with a list of things to check.. I hope i can figure out what is wrong before they put it back together and push it outside...

If he is a reputable shop, he will be afraid of the BBB and do what is right by the customer. Also if the car was in fact driveable when you dropped it off, then he should pay for the tow, to another shop.

So i took my car in to get a new clutch. They changed the clutch and cant get it to work..

Apparently, the clutch fork is frozen and they cant figure it out so they are giving up.

They are still trying to charge me 800 for a clutch replacement, even thought it does not work...

What can i do, i have to get a tow truck to tow it from this shop to another now....

I have till monday...

The BBB is a joke. It has been proven that if you pay them a $400 fee they just upgrade you to A+.

Unfortunately, you're in a bad position. 1) You gave them the car it's not theft. 2) They can hold cars/property/car parts it's called a mechanics lien. But there are rules to when they can and can't hold your property.

Here's your ticket out. Hopefully you have a pre-arranged work agreement in writing BEFORE you gave them the keys; maybe a written quote. If he does not complete the job, he has no legal right to be paid. If he performs any additional work without pre-authorization (and in writing), you don't have to pay for the services. In the event that he hold property without completing the work OR because he raised the price for additional work this is called a "crime of conversion." The second that he demands money for the crime of conversion it crosses over into "Embezzlement."

Read This:
Motor Vehicle Repair - Division of Consumer Services, DOACS

At the bottom, there is a link to report a vehicle repair shop to the state under Chapter 570.544(3) F.S
Notify him before you make the complaint. Ensure him that you will use the term "Embezzlement" in the complaint and notify him after you have made the complaint. Hopefully, this will lead him to alleviate himself of the situation by just releasing the car back to you free of charge.

It's all a scam. The BBB is NOT a government agency. They are supposed to be non-profit, but the CEO of the BBB makes over $400,000/yr or something. I can't remember the exact number. But I know he was in the 1%.
