On my way home my home on the parkway my car slid on black ice, smashed a railing and luckily got grounded on the side. Within the next 10 mins a few more cars spin out n crash.

I would like to make this a legal mattee... Where do I start?

That specific section on the high way is known for that danger yet nothing is done about it. I'm losing job time and my vehicle because of this negligence... It sucks.

Anyone got any ideas?
 
well you should talk to a layer first to see if you have a case against the state or county which ever applys. from there you can get other people who have been in same case in same area as you to get more power towards your cause but that might mean cutting any winnins u get. thats what i can tell you.
 
Thanks for the fast response. I brought it up to geico, I get no collision coverage. But I have a few steps to take to see where I can go with this.
 
You have no case. Its considered an act of God which is protected from litigation.

Fact is you chose to drive, you knew it was cold enough to make ice and you were driving in way that was unsafe for the conditions.
 
it's not the governments responsibility to take care of ice and snow on roads, and whenever they do decide to help it hurts it worse, salt and Magnesium chloride, cause rust and in subzero conditions don't help with black ice.
here the government only salts/sprays chemicals on highways and plows high traffic roads, you don't see anybody trying to sue over lack of winter driving experience(or just plain ability).

if you were to take this to court i believe you have no chance of winning... talk to your lawyer, as spawn said

This is what's wrong with this country. You made a conscious decision I not carry full coverage (and therefore exposing yourself to risk) and then you expect someone else to pay for the damages when something does happen. You said it'd common knowledge that that area gets icy and the government didn't do anything about it. Well you obviously were aware of the dangers also an did nothing about it (i.e. take a different route) yet somehow you have no fault in the incident and the government is to blame entirely and you expect them (all the citizens in that jurisdiction) to pay for you taking a risk by not going with full coverage via their taxes.
 
yup. regardless of all that local governments are very protected when it comes to courtrooms. a few cars got smashed up by a boulder slide here on the interstate and were pissed to find out they could only sue for like 5k max if they wanted to press it that hard. shit sucks but that can happen, they cant be responsible for someone who chose to drive down that street. what if you were on bald tires? and obviously going too fast for conditions? theres just way too many factors that make no sense for them to be responsible.

i was trying to get some help from the city when i blew out two tires and bent two BBSes in a pothole at night on the highway at winter x games and had no such luck. my tow driver informed me he pulled 3 others from the same hole over the weekend and i learned you have to prove beyond a doubt that the city knew about it, had more than ample time to fix it, and it was pure negligence that they didnt. i didnt even bother and just bent over for 1200 in new garbage tires because they were the only ones even in my size. (only one tire shop for the whole area)
