Anyways the shop tried to blame me and had me convinced that it was a bad oil pump finally the guy asked me about the balance shaft removal kit I had them install. they did the complete job other than the oil pump and I had told the guy in the beginning what I wanted done and what the bearings were for anyways when I dropped them off he as in the dad was not there but his son which is his partner I told him specifically what the bearings were for and they needed to be offset he told be we know what to do we have done many of these. the guy said he is willing to take half the cost I said okay but in reality I want him to pay for have of the cost of also installing the engine the head gasket cleaning of the head and possibly a new turbo as there is probably metal in there. My question is what would you do I can probably sue them and win but I dont know everybody please state your opinion.
 
The guy is trying to act like I never told him to install them offset I told him and his son. Its possible that they may lie in court but if his son told the truth bad news for them. I did the work myself but still should be able to charge him the hours X average shop rate for the job having to be done twice because of his mistake.
 
I would assume even if the shop was not informed about how to install it they are still responsible... if they do not know how to do it ...it is there responsiblilty to find out or pass on the job...
 
thier job was to build the motor correctly, and they failed at that so why shouldnt they have to fix thier own mistakes? tell them to fix it the right way completely or you'll see them in court. why pay more when it wasnt your fault in the first place ya know?
 
well good luck in court...you hired them to assemble the short block, and you installed the oil pump..
If you decide to go to court, you may get your money back for what you paid them for and a few days of car rental at most.

you will have to have to prove how the machine shop messed up, what they did wrong, and how it should have been done.
that means you will have to find another machine shop to go to court on your side.

but since you installed the oil pump, and that means you installed the oil pan, all the machine shop has to claim is you allowed dirt/grit or did not clean the oil pan properly, or that you did not prime the oil pump properly, or that you did not prime the engine properly.. ect ect ect...

as far as getting compensated for your turbo, or your time for R&R the engine, your a indavidual, not a shop.. your not ASE cert... so you will not be able to file for a labor claim

it might not be fair.. but thats the way it is...
 
how did they install the balance shaft bearings wrong?? I thought you said that (in one of your other posts/treads) that you were going to a BSE kit?
 
I told them to set them offset but instead they lined them up therefore cy 2 and 3 really hot oil starvation I am going to go along with his little deal if this engine is strong and holds up then we will be ok if it blows again I will try to sue his ass or find a better machine shop
 
from walla walla huh? what machine shop did this? im from tri cities i know the area. that sucks that happened. i had badluck with a bse kit. the stuby shaft froze up on me. engine was all installed and everything. droppin the oilpan and front case is a major pain. i thought the bearings that came with a bse kit were solid all the way around with no oiler hole. weired. either way if theres no shaft in there, the oiler hole needs to be blocked off.
